Seeking Public Comment: Proposed Amendment of Section 200.5 of the Regulations of the Commissioner of Education Relating to Special Education Due Process Hearings
- At their October 2025 meeting, the Board of Regents proposed amendment to section 200.5 of the Regulations of the Commissioner of Education relating to special education due process hearings. The proposed regulatory language is amended to read that due process complaints do not include disputes over the implementation of services in an individualized education services plan (IESP), such as the payment of services by a school district that was obtained by the parents of a student with a disability.
- Beginning October 22, 2025, you are invited to provide comments regarding the proposed action. Submit comments to Christopher Suriano, Associate Commissioner of the Office of Special Education, Room 301M, Education Building, 89 Washington Avenue, Albany, NY 12234 or by email to REGCOMMENTS@nysed.gov.
- Comments must be received by the State Education Department on or before December 22, 2025.
- It is anticipated that the proposed amendment will be presented for permanent adoption at the February 2026 Regents meeting.
