The purpose of this guidance is to answer questions that educators, administrators, and community stakeholders may have about the variance provision included in Education Law §3012-d as amended by Chapter 59 of the Laws of 2019 and Subpart 30-3.16 of the Commissioner’s regulations for the 2019-20 school year and beyond.
